ADMATIC(TM) is a trading name of Immediate Data Ltd, 95 Trevelyan Road, London SW17 9LR, UK

1. Definitions:

• ‘Advertiser’ means a person or body making use of ADMATIC(TM) in order to advertise goods or services, or to place personal messages or any posting of any other nature
• ‘Reader’ means a person or body making use of ADMATIC(TM) for any other purpose other than as an Advertiser
• ‘Service’ means the ADMATIC(TM) searchable classified advertising service on the World Wide Web
• ‘Unlawful’ means such as might give rise to any actual or potential liability, civil or criminal, either under the laws of England, or under the laws of any other jurisdiction to which ADMATIC(TM) may be subject
• ‘Users’ includes both Readers and Advertisers

• permitted only subject to these terms and conditions
• free of charge to Readers
• free of charge to Advertisers placing no more than 10 concurrent advertisements for no longer than 7 days at a time. (Advertisers wishing to place advertisements outside this limitation, or who require facilities to upload advertisements in bulk, should Email for the Terms on which such advertisements can be accepted - for a limited initial period larger quantities of advertisements may be accepted without charge.)

• search the database of advertisements on-line
• respond direct to Advertisers by e-mail, or follow links direct to an Advertiser’s own website

• request e-mail responses to a mailbox without the authority of the owner of the mailbox
• Use the Service for any unlawful purpose or in any unlawful manner

• fully indemnify ADMATIC(TM) against any liability (including the legal costs of a successful defence or of a compromise) on the indemnity basis as a result of any claim being made against ADMATIC(TM) in relation to the use of the Service by the User
• not send mail to ADMATIC(TM) mailboxes other than text messages no longer than 150 characters

• state whether or not any goods or services advertised are offered in the course of a trade or business
• be legally entitled to offer the goods or services they advertise
• ensure that all advertisements they submit are in no way unlawful, and comply in all respects with the British Code of Advertising Practice

• opt to use a mailbox number (to be allocated by ADMATIC(TM)) for the receipt of replies to advertisements

• reserves the right in its absolute discretion to refuse or remove any advertisement (without being required to give reasons), and to edit or classify any advertisement as it sees fit
• reserves the right in its absolute discretion to withdraw the use of its Service from any person or body without notice and without being required to provide reasons
• retains copyright in the advertisement database
• makes no warranties with respect to the Service

• all material published by ADMATIC(TM) is published in good faith, but in no circumstances is any responsibility accepted for the accuracy of any advertisement or message published (nor is any warranty expressed or implied by such publication) and ADMATIC(TM) specifically disclaims all and any liability to Users of any kind for loss or damage of any kind and howsoever arising, whether due to inaccuracy, error, omission, or any other cause, and whether on the part of ADMATIC(TM) or on the part of any other
• TO THE EXTENT PERMITTED BY THE APPLICABLE LAW, ADMATIC(TM) DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE SERVICE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE
• the Service is provided ‘as is’, and Users acknowledge that it is not technically practicable to guarantee such a service :to be error-free. Users agree that if any errors are found to exist they shall not constitute a breach of these Terms, and shall not give rise to any liability
• in no event will ADMATIC(TM) be liable for indirect, special, incidental or consequential loss or damage which may arise in respect of the Service, its use, or in respect of other equipment or property, or for loss of profit, business, revenue, goodwill or anticipated savings, even if ADMATIC(TM) has been advised of the possibility of such loss
• in the event that any exclusion contained in these Terms shall be held to be invalid for any reason and ADMATIC(TM) becomes liable for loss or damage that may lawfully be limited, such liability shall be limited to £100 or (if your claim arises as an Advertiser) the sum paid by you for the Advertisement (if higher)
• ADMATIC(TM) does not exclude liability for death or personal injury to the extent only that it arises as a result of its negligence or that of others for whose acts and defaults they may be legally liable

• by using the Service Users accept that these Terms supersede all prior agreements, and are complete and exclusive. No oral or written information given by or on behalf of ADMATIC(TM) shall create a warranty or collateral contract, or in any way increase the scope of this warranty in any way, and Users may not rely on any such information
• the right is reserved to change these Terms from time to time; any such revised Terms may be viewed at log-in
• if any provision in these Terms shall be determined to be invalid, such provision shall be deemed omitted; the remainder of these Terms shall stand
• these Terms shall be governed by the laws of England, and the courts of England shall have exclusive jurisdiction in all matters arising
